Fair Or Unfair?

Hi all,i've recently had a problem with one of the scaley camaro's i've purchased on Ebay.They item arrived with a fair bit of damage on it,whether by the seller or in courier i'm uncertain,but assume in transit.I bought the car for just shy of $100 including postage & the seller has offered to give me $20 refund,do you think that is a fair offer?The seller has sent me a few car previous that were alot better packed then this car & they came mint.What would you do?I'll include some pics to show the damage.cheers

Rear spoiler is off & someone seems to have attempted to reglue it,also a scratch on the roof.

Don't muck around, you are totally within your rights to ask for a replacement. The car is not as described is it? If a replacement is not available you should get a refund. I don't know if this would include postage. If you used PayPal they are actually quite good with this sort of thing.

Tomi, ask for a full refund, to me the chassis crack was caused by the screw turned to tight without the correct spacing, $20 is not good enough report the seller.

 

The same model i was going to send to you had no issues like that, but a good seller recognise's any problems with items before sending..

I'd be pushing it further. So much, though, depends on the way the item was described. If it was described as "Mint" then if you don't get any response from eBay there's a chance of it being esculated beyond an eBay complaint.

 

But, given the condition, I'd be looking for more recompense than $20. It's up to you if you can swallow the damage or not. Again, depending on the description.

Thanks for the feedback all.I've payed with paypal,& am hoping he'll want to resolve this without much fuss.He's said he cannot fully refund & that he cannot replace the car as it is the only one he has.He stated the car as New.Here's what he had on the item description on ebay.

If there is evidence of gluing it's not

MINT NEVER USED IN ORIGINAL BOX
simple as that.

 

If you don't get resolution from the seller I'd esculate it further. If no satisfaction from eBay there is the possibility of going beyond (ie: Consumer Affairs)

There is no chance the damage was caused in the mail.

 

Was there a spacer between the base and the chassis where the retaining screw goes. If not, this would have caused the chassis damage. Rear spoilers are not glued! and roof scratches are optional at extra cost. LOL.

I'd be asking for a refund Dwanted1 - if the Spaniard is serious about continuing to flog his stuff through the Aus eBay then surely he wants to keep his reputation in tack?

 

I've seen an explosion of the Spain sellers selling stuff on the Aus eBay lately, never bought anything myself but some very tempting rare items up for sale every now and then.

There is no way that the spoiler damage can have been caused "in transit" if there is evidence of attempted glued repair. That is evidence enough to refute the claim of the item being "MINT NEVER USED IN ORIGINAL BOX."

 

If you can not get satisfaction of full refund on return I'd be reporting dissatisfaction to eBay. If no satisfaction there it can be esculated beyond eBay (and eBay are very wary of such things)

File the case with ebay and negotiate with the seller through ebay so it is all recorded. If they do not FULLY refund the price, escalate it to a claim, don't waste time with promises etc from the seller. They will want to drag it out so the claim time passes. don't leave feedback til it's sorted

Hey Mark,i've dealt with him twice before & got a nice #1 stang & the street camaro.This time the packing was not like before with nothing like bubblewrap cushioning the car.

 

Ps The range car will surely go over the pricetag of the last one that was on offer on Ebay,think it was $507AU.Am tempted but i think i'll pass.

Glue to hold rear wing on is NOT mint condition. Full refund or escalate it. No exceptions. These people have to learn they can't dump their crap on our market. :)

I sold around 25 car's on Evilbay over the last month and 1 buyer messaged me saying the car was not new as in description, apparently the braids looked used and a screw was missing.

 

I know this car was new....BUT i still offered a full refund including postage costs both way's and i also asked for a detailed picture of the underside...he has declined both... :D .

Yeah I agree, that you should get your money back.

 

Just keep an eye on how long it's been since the transaction as you've only got a certain number (45?) of days to make the claim if he stuffs around.

If you go past that, PayPal won't be interested to help.

 

That happened to me a few years ago, and I claimed (and got) the money back via ANZ. PayPal threatened to cancel my account because I didn't follow their protocol, but I got the money back for an item that never arrived.

 

Good luck with it, hope it all works out.
